What is the Online Gaming Bill 2025?

The Indian government passed the Online Gaming Bill 2025 on 19th August 2025, in the Lok Sabha and got approval from the Rajya Sabha on 21st August 2025. This new legislation was presented to transform the digital gaming scenario in India. While encouraging certain online games, the government is imposing strict constraints on real-money games and gambling platforms. The bill was intended to promote esports, educational games and social gaming to ensure legal and strategic implementation.   • The actual reason to introduce the bill was to create a balance between the promotion of innovative esports and preventing citizens from falling prey to fraud, as well as risking money in gambling and betting.
  • With the major increase in cyber fraud, the government was forced to take a strict stance on real money games addiction, gambling and social harm. Also, reports of crimes and suicide increased due to the loss of money on money-based gaming platforms.

Classification of Online Games-

According to the government’s Online Games Bill, digital games are divided into 4 classifications:

  1. E-Sports
  • Games that are competitive and skill-based, played in an appropriate format with predefined rules, such as cricket, soccer, etc. 
  • Video games that are driven by strategic skills like dexterity, agility, and teamwork. 
  • Under the supervision of a centralised authority, the government wants to promote e-sports through specific guidelines for training, multiplayer tournaments, events, research and integration with broader sports policy. 
  • Prize money and a nominal fee may be applicable, but games involving betting and gambling are completely banned.
  1. Social Games
  • Social games such as chess, ludo, sudoku, solitaire, etc. that are for recreational or casual purposes. They do not involve any monetary deposits but are regulated, prioritising to ensure secure gameplay. 
  • The bill anticipates supporting these games with user-protection features like age-appropriate access, data security, and basic compliance norms supervised under the leading authority.
  • The game format will be light and recreational. There will be no stake or money-related concept in these games. 
  1. Educational Games
  • Games that are meant for learning, cognitive development and focus on skill building are termed as educational games.
  • These types of games have a positive impact on children and adults that helping in the personal growth of an individual, and are used for casual purposes.
  • Quizzes, puzzles, coding, language learning apps, etc., are examples of educational games that give some knowledge and help in skill development are legitimate channels that do not involve financial risks. 
  1. Online Money Games
  • The online money games are those games that involve real money as a deposit or fees, regardless of skills or strategy, such as gambling, betting, rummy/poker, fantasy sports and stake.
  • India has completely banned these types of games due to heavy financial risk, online fraud, addiction, money laundering, and social distress caused by predatory gaming platforms in the hope of monetary returns or equivalent rewards. 
  • The new bill punishes violators by imposing a fine of Rs 1 crore or more and 2 to 5 years of imprisonment for advertising, facilitating, transacting or offering these online real money games.

  • Ban on online real money games: The game formats, such as online poker, rummy, betting, fantasy games, etc., are expected to shut down, forcing businesses to exit from the gaming industry.

  • Information Technology Act 2000 & Intermediary Guidelines
    • IT(Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; amended in 2023, state “Platforms must ensure no unlawful or harmful gaming content, including money games. Those facilitating money games must be registered under the Self-Regulatory Bodies (SRB) to access game permissibility.  
    • Section 69A of the IT Act allows the government to ban illegal online gaming and betting platforms.
  • BNS-Bhartiya Nayaya Sanhita (2023)
    • Section 111: Unlawful economic activities and cybercrimes
    • Section 112: It punishes offenders engaged in gambling and betting with imprisonment of 1 to 7 years of prison and a fine.
  • Government Advisories
    • An advisory was issued by the Ministry of Information and Broadcasting (MIB) in 2022-2024, cautioning advertisers and influencers against promoting misleading online betting.
    • Also, the Ministry of Education stated guidelines for parents and educators promoting safe and responsible gaming habits among children.
  • Penalties Under New Online Gaming Bill 2025
    • The bill punishes the following violators such as:
    • Operators/Facilitators: 3 years of prison and a fine of Rs. 1 crore.
    • Advertisers/Promoters/financial intermediators: 2 years of prison and a fine of Rs. 50 Lakhs.
    • Repeat Offenders: Cognizable and Non-Bailable offence, 3-5 years of prison and fine of Rs. 2 crore.
